Terms of service

1. Acceptance of Terms
By using RocaVoice, a service provided by Roca LLC (“we,” “us,” or “our”), a Wyoming limited liability company, you (“Client,” “you,” or “your”) agree to these Terms of Service (“Terms”). If you do not agree, do not use our services.

2. Service Description
RocaVoice provides an inbound AI voice agent that answers customer calls for your business, using your website data to respond to inquiries and book appointments. An outbound demo call is provided during the signup process to showcase the service. The service is intended for small businesses in the United States.

3. Fees and Payment

  • Setup Fee: A one-time, non-refundable setup fee of $500 is required to activate your RocaVoice account. This fee covers initial onboarding and setup of your inbound AI agent.
  • Monthly Fee: A recurring fee of $250 per month provides 200 minutes of inbound call time. This fee is charged automatically to your payment method on file on the same day each month (e.g., if you sign up on April 10, the next charge is May 10).
  • Overage Fees: Usage beyond 200 minutes per month is billed at $0.25 per minute. Overage fees are calculated at the end of each billing cycle and charged separately to your payment method on file.
  • Payment Method: You must provide a valid payment method (via Stripe) to use the service. You authorize us to charge all fees automatically. If a payment fails, we may suspend your account until payment is received.
  • Taxes: All fees exclude applicable taxes, which you are responsible for paying.

4. Billing and Cancellation

  • Billing Cycle: The monthly fee is charged every 30 days from your signup date. Overage fees are billed within 5 days of the billing cycle’s end.
  • Cancellation: You may cancel your subscription at any time by emailing support@rocavoice.com. Cancellation takes effect at the end of the current billing cycle—no prorated refunds are provided. The setup fee remains non-refundable.
  • No Refunds: Except as required by law, all fees (setup, monthly, overage) are non-refundable.

5. Service Usage and Limitations

  • Usage Limits: Your subscription includes 200 minutes of inbound call time per month. Overages are tracked and billed as described in Section 3.
  • Service Availability: We strive to provide uninterrupted service but do not guarantee 100% uptime. We are not liable for downtime due to maintenance, technical issues, or third-party failures (e.g., Synthflow, Zapier).
  • Prohibited Use: You may not use RocaVoice for illegal activities, spam, or to violate any laws. We reserve the right to suspend or terminate your account for misuse.

6. Client Responsibilities

  • Accurate Information: You must provide accurate website data and contact information for the AI agent to function correctly. We are not responsible for errors due to inaccurate data.
  • Compliance: You are responsible for ensuring your use of RocaVoice complies with all applicable laws, including telemarketing and privacy regulations (e.g., TCPA, GDPR if applicable).

7. Intellectual Property
All technology, scripts, and content provided by RocaVoice are our property or licensed to us. You are granted a non-exclusive, non-transferable license to use the service during your subscription term.

8. Limitation of Liability
To the fullest extent permitted by law, Roca LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of RocaVoice, including lost profits or business opportunities. Our total liability shall not exceed the fees paid by you in the prior 3 months.

9. Termination
We may terminate your account for non-payment, misuse, or violation of these Terms, with notice via email. Upon termination, you remain liable for any outstanding fees.

10. Governing Law
These Terms are governed by the laws of the State of Wyoming, USA. Any disputes shall be resolved in the state or federal courts of Wyoming.

11. Changes to Terms
We may update these Terms at any time. Changes will be posted on rocavoice.com, and continued use of the service constitutes acceptance of the updated Terms.
